Please read these terms and conditions carefully, by accessing or using this internet-based platform, you agree to be bound by the terms described herein and all terms incorporated by reference. If you do not agree to all of these terms, do not use this internet-based platform.
What is MEDAID
- The domain name www.MEDAID.one, an internet-based portal, and MEDAID mobile application is operated by MEDAID TECHNOLOGIES Private Limited (hereinafter referred to as "MEDAID" or "We" or "Our" or "Us" or "Company") having registered office at Plot NO.23 & 24, Chikoti Gardens, Old Patigadda, Begumpet, Hyderabad, Telangana 500016.
- By accessing, browsing, or in any way transacting on the Website, or availing any Services, You signify Your agreement to be bound by these Terms and Conditions. Further, by impliedly or expressly accepting these Terms and Conditions, you also accept and agree to be bound by Our policies, including the Privacy Policy and such other rules, guidelines, policies, terms, and conditions as are relevant under the applicable law(s) in India and other jurisdictions to access, browse or transacting on the Website, or availing any of the Services, and such rules, guidelines, policies, terms, and conditions, shall be deemed to be incorporated into, and considered as part and parcel of these Terms and Conditions. However, if You navigate away from the Website to a third-party website, You may be subject to alternative terms and conditions of use and privacy policy, as may be specified on such website.
- MEDAID reserves the right to change or modify these Terms and Conditions or any policy or guideline of the Website including the Privacy Policy, at any time and its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions on the Website and You waive any right You may have to receive specific notice of such changes or modifications, provided however that, we will inform You of such changes at least once a year. Your continued use of the Website will confirm Your acceptance of such changes or modifications; therefore, You should frequently review these Terms and Conditions and applicable policies to understand the terms and conditions that apply to Your use of the Website.
Conditions Of Use
- As a condition to Your use of the Website, You must be 18 (eighteen) years of age or older to use or visit the Website in any manner. By registering, visiting, and using the Website or accepting these Terms and Conditions, You represent and warrant to MEDAID that You are 18 (eighteen) years of age or older and that You have the right, authority, and capacity to use the Website and the Services available through the website, and agree to and abide by these Terms and Conditions Agreement.
Private & Secure Health Vault Service
- Users may use this service to manage all medical cases, appointments, and other medical records and map a digital overview of the User's medical journey. User agrees that usage of this Service, Portal may receive User's medical records including User's diagnostic & other lab reports and doctor prescriptions from both Third Party Service Providers and/or directly from the User(s).
- The accuracy, integrity, and completeness of the information provided in the Health Vault depend on the information provided by users or the User authorized Third Party Service Provider. The Portal is merely a facilitator communicating or storing information and does not in any manner alter the information uploaded on the said Health Vault. MEDAID shall in no event be liable for any losses or injuries suffered by User or arising out of any actions or omissions made by User or any other person including a Third Party Service Provider relying on the information provided in the Health Vault.
Consultation Services
- The Portal facilitates video/tele/e-consultation services by providing user access to and enabling interaction with Medical Experts.
- While We take reasonable efforts to ensure that relevant information about Medical Experts such as their specialization, qualification, area of practice, experience, fees, location, visiting hours, etc. provided under the Consultation Service is accurate and updated at frequent intervals, we shall not be liable for any inaccuracies or incompleteness of such information or any direct or indirect losses or injuries caused on account of such inaccuracies or incompleteness.
- We make no guarantees, representations, or warranties, whether expressed or implied, concerning professional qualifications, quality of work/advice, or expertise of the Medical Experts providing Consultation Services and shall in no event be liable for any claims about malpractice, negligence, deficiency of services on the part of the Medical Expert.
- The Consultation Service is provided for medical ailments, disorders, diseases, etc. which do not require any physical intervention of a Medical Expert or which do not constitute a medical emergency such as accidents, bleeding injuries, burns, sexual abuse/assault, etc. In case you required the physical attention or care of a Medical Expert or are suffering a Medical emergency, You are urged not to use the consultation Services. The use of the Consultation Services shall be at your judgment and perception, we shall not be, directly or indirectly, liable for any lapse in Your judgment that may result in any injury or loss, nor shall we be liable for the use of the ConsultationServices in contravention of the terms mentioned in this Agreement.
- Consultation Service is provided at the express consent of the User and the same shall not be construed as a replacement for physical consultation and is meant for general consultation only.
- If on availing of Consultation Service on Portal, the User has been recommended to undergo any diagnostic tests or is issued a prescription, the same are provided based on the information and preliminary examination, hence, the same shall not be treated as accurate, final, and conclusive.
- Any prescriptions made by the Medical Expert basis the ConsultationServices shall be at the sole discretion of the Medical Expert and such medical Expert shall be solely responsible for making such prescription. MEDAID does not endorse any prescription nor does it deal in medical drugs. The use of any medical drugs prescribed by the Medical Expert during the Consultation Service may be taken at the User's discretion and sole responsibility.
- By availing Consultation Services, User provides its consent to MEDAID for recording, saving, and storing for record purposes all such Consultation Services availed through the Portal by User in the event such records are required to be produced as evidence on the direction of a court of law.MEDAID may review such data from time to time for quality evaluation purposes. However, under normal circumstances, MEDAID will not access any information that identifies a User and shall either omit, mask or anonymize the User's personal information at the time of quality evaluation.
Eligibility
To avail of the Services and/or transact with the Third Party Service Providers through the Website, You are required to obtain registration, by the procedure established by MEDAID in this regard. As part of the registration process, MEDAID may collect the following personal information from You:
- Name;
- User ID;
- Email address;
- Address (including country and ZIP/ postal code);
- Gender;
- Age;
- Phone number;
- The password is chosen by the User;
- Valid financial account information; and
- Other details as You may volunteer.
- User camera access (for documents and user profile setup)
- The registration on or use/ access of the Website is only available to natural persons, other than those who are 'incompetent to contract' under the Contract Act. That is, persons including minors, un-discharged insolvents, etc. are not eligible to register on, or use/ access the Website. By registering, accessing, or using the Website, You accept the terms of these Terms of Use and represent and warrant to MEDAID that you are 'competent to contract' under the Contract Act and have the right, authority, and capacity to use the Website and agree to and abide by these Terms and Conditions.
- A registered id can only be utilized by the person whose details have been provided and MEDAID does not permit multiple persons to share a single login/ registration id. However, a registered user, being also a parent or legal guardian of a person 'incompetent to contract' such as minors or persons with unsound mind, would be permitted to access and use the Website to procure the Services, on behalf of such persons.
- Organizations, companies, and businesses may not become registered members on the Website or use the Website through individual members.
- The Website uses temporary cookies to store certain data (that is not sensitive personal data or information) that is used by MEDAID for the technical administration of the Website, research and development, and User administration. In the course of serving advertisements or optimizing services to You, MEDAID may allow authorized third parties to place or recognize a unique cookie on the Your browser.MEDAID does not store personally identifiable information in the cookies.
- MEDAID, at its sole discretion, reserves the right to permanently or temporarily suspend Users, to bar their use and access of the Website and App, at any time while MEDAID investigates complaints or alleged violations of these Terms and Conditions or any Services, or for any other reason.
User Content
- For the provision of Services, MEDAID may allow the User to upload their existing medical records, maintain a repository of reports received from ThirdParty Service Provider, text, files, images, photos, video, or any other materials and to inter alia enables the User to provide Third Party ServiceProvider rating/ feedback, etc. (collectively, "User Content").
- The User and/or Third Party Service Providers undertake to share or allow sharing of User Content with MEDAID at their own risk.MEDAID reserves the right to retain such information to provide Services to the Users.
- MED-AID reserves the right, in its sole and absolute discretion, to determine whether User Content is appropriate; and to remove any user content, without notice or liability to you, which it determines to be inappropriate. Without limiting the generality of the foregoing, the following is a partial list of the types of User Content that MEDAID deems to be inappropriate:
- Content belonging to another person and to which a User does not have any right;
- Content that infringes the intellectual property of any party;
- Content that contains nudity, violence, or offensive subject matter or contains a link to an adult website;
- Content that includes racially, ethically, or otherwise objectionable language;
- Content that is libelous, defamatory, or otherwise tortious language;
- Content that contains any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs, or other computer programming routines or executable files that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information of any person whatsoever;
- Content that involves commercial activities and/or sales without MEDAID'S prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes.
User Guidelines
- In consideration of MEDAID granting you a license to use the Portal, you hereby agree not to use the Portal for any purpose that is unlawful under any applicable laws and/or in violation of these Terms of Use and our Privacy Policy. You shall not use the Portal in any manner that could damage, disable, overburden, or impair any MEDAID server, any network(s) connected to any MEDAID server, or interfere with any other party's use and enjoyment of the Portal. You shall not attempt to gain unauthorized access to any functions and features, other User accounts, computer systems, or networks connected to any MEDAID server, in any manner, including, through hacking, password mining, or any other unlawful means. You shall not obtain or attempt to obtain any materials or information through any means which is not intentionally made available through the Portal.
- You shall, directly or indirectly through third parties, not:
- (a) make and/or distribute copies of the Portal;
- (b) attempt to copy, reproduce, alter, modify and/or reverse engineer the Portal; and/or
- (c) create derivative works of Portal.
- You accept that any operations emanating from your device shall be assumed to have been initiated by you.
- You shall request MEDAID to disable your account and change the password immediately for the account if your device (wherein the Portal account may be signed in) has been lost or stolen.
- You are responsible for any activities that occur in your account. You agree to notify MEDAID immediately in the event of unauthorized use of the User account or any other form of a security breach. MEDAID shall not be liable for any loss to you or your organization owing to negligent actions or a failure on your part to inform MEDAID, within a reasonable time, about the loss or theft of your device and/or any unauthorized access to your account, either with or without your knowledge. Further, you shall not use any other person's account at any time, without express prior written permission of the concerned account holder and MEDAID.
- You shall be liable for losses incurred by MEDAID or any other party due to a third party's use of your account.
- You shall ensure that, while using the functions and features of the Portal, all applicable laws, rules, and regulations shall, at all times, be strictly complied with by you. MEDAID shall not be liable in any manner whatsoever for default of any nature by you.
- You agree that the Portal may be linked to the website of third parties, affiliates, and business partners and that MEDAID has no control over, and is not liable or responsible for the content, accuracy, validity, reliability, or quality of such websites or made available by/through the Portal. The inclusion of any link on the Portal does not imply that MEDAID endorses the linked website. Other Parties may use the links and these services at their own risk.
- The user agrees that certain Services on the Portal may require payment of fees such as consultation fees. MEDAID and/or Third Party Service Provider, as the case may be, reserves the right to revise Service charges at any time, at their sole discretion. The charge, applicable at any given time, will be the charge displayed at the time of using the respective Service.
Terms for use of the Online Doctor
Consultancy Services:
- MEDAID is an online health platform that provides a variety of online and online-linked health products and services to Users for health-related information and resources. Whenever We use the words "Your physician" "Your doctor" "healthcare provider" or similar words on the Website, including in these Terms and Conditions, We mean Your doctor with whom You have an actual, mutually acknowledged doctor-patient relationship. Medaid's Medical Experts are not "Your" physician or healthcare provider.
- NO DOCTOR-PATIENT RELATIONSHIP: MEDAID does not replace Your relationship with a physician or healthcare provider. The information interpreted SHOULD NOT be relied upon as a substitute for sound professional medical advice, evaluation, or care from Your physician or another qualified healthcare provider.
- You acknowledge that the Medical Experts impaneled with Us are independent contractors and thereby MEDAID has an independent contractor relationship with such Medical Experts therefore in no event MEDAID will be directly or vicariously liable for any advice or medical consultancy or any loss arising therefrom that the Medical Experts may provide to You or You may avail as part of the Services.
- You acknowledge that the e-prescription which may be issued by the medical expert(s), in certain events, is not a valid prescription under applicable law(s) of India and may not be used for dispensation of medicines by any pharmacist including the Third Party Pharmacies. You further agree and acknowledge that if You request us to process the e-prescription or any form of prescription (whether an original or scanned copy of the original prescription) for the facilitation of medicine orders, then we will only act as an aggregator and assume no responsibility and/ or liability about the dispensation of the medicines, which shall at all times be at your sole risk and the sole responsibility of the Third Party Pharmacies supplying the medicines to you.
- You acknowledge that although some of the content, text, data, graphics, images, information, suggestions, guidance and other material (collectively, "Information") that is provided to You on the Website (including Information provided in direct response to Your questions or postings) may be provided by individuals in the medical profession, the provision of such Information does not create a doctor/medical professional-patient relationship but is provided to inform You on various medical conditions, medical diagnosis and treatment and it does not constitute a direct medical diagnosis, treatment or prescription. Everything on the Website should be used for information purposes only.
- MEDAID is designed to support the health decisions and choices that You make. These decisions and choices are Yours, and We believe that You, in connection with the advice You receive from Your doctor or another professional healthcare provider, are the best decision-maker about Your health. We cannot make decisions for you. However, what We can do is help You find good health information and connect with doctors for in-person information. On MEDAID You can ask and find informational questions and related educational answers from Medical Experts. The Website is not a place for the practice of medicine, but Medical Experts on the Website can be a resource for reliable, relevant general health information.
- Even if Your real-life doctor is on MEDAID, personal medical advice, treatment, or diagnosis is not permitted through the Website, and by using the Website You agree not to solicit these or use any information as if it were personal advice, treatment, or diagnosis. Whenever You want personal medical advice, treatment, or diagnosis, You should contact Your physician or professional healthcare provider and see them in person.
- We do not recommend or endorse any specific Medical Expert(s), tests, products, procedures, opinions, or other information that may be mentioned on the Website. Reliance on any information provided on the Website is solely at Your own risk. In case of any medical emergency, kindly contact Your nearest doctor/hospital or any related helpline.
- The Services are not for use in medical emergencies or critical health situations requiring prompt medical attention. The Services are not intended to be real-time and may not be the best solution when a face-to-face consultation is a must therefore We strongly discourage any delay in seeking advice from Your doctor on account of something that You may have heard/viewed on the Website. You take full responsibility for ensuring that the information submitted is accurate and MEDAID shall not make any effort to validate any information provided by You for using the Services concerning the content, correctness, or usability. We, to provide the best services possible, could ask You to share more information as and when needed.
- The opinions, statements, answers, and teleconsultations (collectively "Consultation") provided by the Medical Experts through the Website are solely the individual and independent opinions and statements of such Medical Experts and do not reflect the opinions of MEDAID, its affiliates, or any other organizations or institutions to which such Medical Expert or such specialist or professional is affiliated or provides services. MEDAID does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the Website or by a licensee of MEDAID.
- The inclusion of professionals, specialists, and/ or Medical Experts on the Website or in any professional directory on the Website does not imply a recommendation or endorsement of such specialists and/ or Medical Experts nor is such information intended as a tool for verifying the credentials, qualifications, or abilities of any specialists and/ or Medical Experts contained therein. Such information is provided on an 'as-is' basis and MEDAID disclaims all warranties, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
- MEDAID (the owners and the employee staff of MEDAID), Medical Experts, and third-party professionals who offer the Services through the Website accept no responsibility for any medical, legal, or financial events or outcomes related to the Services availed through the use of the Website.
- MEDAID makes no warranty that the Services will meet Your requirements, or that the Service(s) will be uninterrupted, timely, secure, or error-free. This includes loss of data or any service interruption caused by MEDAID employees.MEDAID is not responsible for transmission errors, or corruption of data.
- MEDAID is for personal use and the Services are for individuals to use for supporting their personal health decisions. You may use the Website for personal, but not for commercial, purposes.
- The Website may not be used for illegal purposes. The Information and Services may not be used for any illegal purpose. You may not access our networks, computers, or the Information and Services in any manner that could damage, disable, overburden, or impair them, or interfere with any other person's use and enjoyment. You may not attempt to gain unauthorized access to any Information or Services, other accounts, computer systems, or networks connected with the Website, the Information, or Services. You may not use any automated means (such as a scraper) to access the Website, the Information, or the Services for any purpose. Such unauthorized access includes, but is not limited to, using another person's login credentials to access his or her MEDAID profile/ account. Any attempt by any individual or entity to solicit login information of any other user or Medical Expert or to access any such account is an express and direct violation of these Terms and conditions and applicable law(s), including relevant privacy and security laws and laws prohibiting unfair or unethical business practices.
- Your right to use the Services is not transferable.
- Notwithstanding anything to the contrary contained herein, You alone shall be liable for Your dealings and interaction with patients or Medical Experts (as the case may be) contacted or managed through the Website and MEDAID shall have no liability or responsibility in this regard. MEDAID does not guarantee or make any representation concerning the correctness, completeness, or accuracy of the Information or detail provided by such client, patient, User, Medical Experts, or any third party through the Website. The Services should not be used for emergency appointment purposes.
- The exchanges between the Medical Experts and the patient through the chat window or over the telephone (as the case may be) and the e-prescription would be accessible to MEDAID to monitor the quality of the consultation.
- MEDAID may, at its sole discretion, suspend the User's or Medical Expert's ability to use or access the Website at any time while MEDAID investigates complaints or alleged violations of these Terms and Conditions, or for any other reason. MEDAID has the right to edit the profiles of Medical Experts to make them more suitable for patient/User searches on the Website.
- The Services should not be depended upon and should not be treated as a replacement for obtaining consultation for diseases as the consultation provided through the Website is generic in approach and shall not and cannot act as a substitute for physical consultation with a doctor. Also, the Consultations provided through the Website are not diagnostic.
Book An Appointment And Call The Facility
- MEDAID enables Users to connect with Practitioners through two methods.
- Book facility that allows Users to book an appointment through the Website.
- Value-added telephonic services which connect Users directly to the Practitioner's number provided on the Website.
- MEDAID will ensure Users are provided with confirmed appointments on the Book facility. However, MEDAID has no liability if such an appointment is later canceled by the Practitioner, or if the same Practitioner is not available for an appointment.
- If a User has utilized the telephonic services, MEDAID reserves the right to share the information provided by the User with the Practitioner and store such information and/or conversation of the User with the Practitioner, by our Privacy Policy.
- The results of any search Users perform on the Website for Practitioners should not be construed as an endorsement by MEDAID of any such particular Practitioner. If the User decides to engage with a Practitioner to seek medical services, the User shall be doing so at his/her own risk.
- Without prejudice to the generality of the above, MEDAID is not involved in providing any healthcare or medical advice, or diagnosis and hence is not responsible for any interactions between the User and the Practitioner. The user understands and agrees that MEDAID will not be liable for:
- User interactions and associated issues User has with the Practitioner;
- the ability or intent of the Practitioner(s) or the lack of it, in fulfilling their obligations towards Users;
- any wrong medication or quality of treatment being given by the Practitioner(s), or any medical negligence on part of the Practitioner(s);
- inappropriate treatment, or similar difficulties or any type of inconvenience suffered by the User due to a failure on the part of the Practitioner to provide agreed Services;
- any misconduct or inappropriate behavior by the Practitioner or the Practitioner's staff;
- Users are allowed to provide feedback about their experiences with the Practitioner, however, the User shall ensure that the same is provided by applicable law.
- The following instances, solely at the discretion of MEDAID, would be construed as valid cases of PNS ("Valid PNS"), in which case the User shall be penalized as per
- Where the User has booked a paid appointment and is unable to visit the Practitioner, due to such genuine reasons of sickness, etc. at the sole discretion of MEDAID, under conducting of investigation, the User shall be provided with a refund of such payment made by User, at the time of booking. However, where cancellation charges have been levied, you would not be entitled to a complete refund.
- MEDAID reserves the right to make the final decision in case of a conflict. The total aggregate liability of MEDAID concerning any claims made herein shall be INR 300.
Cancellation And Refund Policy
- If the Practitioner with whom the User has booked a paid appointment via the Website, has not been able to meet the User, the User will need to write to us at support@medaid.one within five (5) days from the occurrence of such event; in which case, the entire consultation amount as mentioned on the Website will be refunded to the User within the next five (5) to six (6) business days in the original mode of payment done by the User while booking. In the case where the User, does not show up for the appointment booked with a Practitioner, without canceling the appointment beforehand, the amount will not be refunded and treated as under Clause 3.4.6. However, where cancellation charges have been levied (as charged by the Practitioner/Practice), you would not be entitled to a complete refund even if you have canceled beforehand.
- Users will not be entitled to any refunds in cases where, the Practitioner is unable to meet the User at the exact time of the scheduled appointment time and the User is required to wait, irrespective of the fact whether the User is required to wait or choose to not obtain the medical services from the said Practitioner.
Online Payments
Please read these terms carefully before using the online payment facility. Using the online
payment facility on this website or application indicates that you accept these terms. If you do not accept
these terms do not use this facility. The country of domicile for MedAid
is India.
The description of services of match making are specific to your need, when you log in with
your unique password. Normally payment is required in advance (i.e. before you commence
your activity).
All Fees quoted are in Indian Rupees. MedAid reserves the right to change the fees
at any time.
All payments are subject to the following conditions:-
- Your payment will normally reach the MedAid account to which you are
making a payment within two working days.
- We cannot accept liability for a payment not reaching the correct MedAid
account due to you quoting an incorrect account number or incorrect personal details.
Neither can we accept liability if payment is refused or declined by the credit/debit
card supplier for any reason.
- If the card supplier declines payment the MedAid is under no obligation to bring
this fact to your attention. You should check with your bank/credit/debit card supplier
that payment has been deducted from your account.
- In no event will the MedAid be liable for any damages whatsoever arising out of
the use, inability to use, or the results of use of this site, any websites linked to this
site, or the materials or information contained at any or all such sites, whether based
on warranty, contract, tort or any other legal theory and whether or not advised of the
possibility of such damages.
- Payment gateway Transaction charges are to be borne by the citizens only.
DND Policy
If you wish to stop any further sms/email alerts/contacts from our side, all you need to do is
